This Terms of Service ("Agreement") constitutes a legally binding agreement between you, the user (“you”), and the Unburdening Rites entity (“the Service,” “we,” “us,” “our”). This Agreement governs your use of our website and the services we provide.

By accessing our Site and using our Service, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions of this Agreement. If you do not agree with all of these terms, you are expressly prohibited from using the Service and must discontinue use immediately.

1. Description of Service The Service provides two distinct functions: "Invocations" and "Testaments."

a. Invocations: This function allows a user to submit a message ("The Unpleasant Truth") for dispassionate, verbal delivery to a third party (“the Recipient”) via a telephone call. The Service is limited to telephone numbers within the United States only. Invocations may be fulfilled with or without a corresponding monetary "Offering," as detailed on the submission form.

b. Testaments: This function allows a user to anonymously submit a confession or statement for public consideration. Testaments are not delivered to a specific party but may be selected by the Service to be read and published.

Both Invocations and Testaments are subject to being recorded and publicly published on various platforms, including but not limited to YouTube, as part of a public archive ("the Ledger") for artistic, social commentary, and entertainment purposes.

2. User Representations and Warranties By submitting an Invocation or a Testament, you represent, warrant, and covenant that: a. You are at least 18 years of age and have the legal capacity to enter into a binding contract. b. All information you provide is truthful, accurate, and provided in good faith. c. For Invocations, you have a bona fide, pre-existing relationship with the Recipient. d. For Invocations, you have the full legal right and have obtained all necessary and legally required consents, in accordance with all applicable federal, state, and local laws (including, but not limited to, one-party and two-party consent laws for call recording), to have this message delivered to the Recipient, to have the ensuing conversation recorded, and to have that recording publicly published. e. The content of your message does not violate any law or the rights of any third party. f. The Recipient of the call is, to the best of your knowledge, at least 18 years of age.

10. Governing Law and Dispute Resolution This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Any legal action shall be brought in the state or federal courts located in Arapahoe County, Colorado.

11. Modification of Terms We reserve the right, in our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
